Terms of Service

AKMSign is operated and provided by AKM Digital Solutions.
These Terms of Service govern access to and use of AKMSign, an electronic document signing and document workflow platform. By creating an account, joining a workspace or signing a document through AKMSign, you agree to these Terms. AKMSign is operated and provided by AKM Digital Solutions ("AKM Digital Solutions", "we", "us"); references to AKMSign in these Terms mean the service provided by AKM Digital Solutions.
1. The service
AKMSign is a software-as-a-service platform for electronic document signing and document workflows. Customers may upload documents, place signature and data fields, route documents to recipients in a defined order, track progress, and download completed documents together with a completion certificate.
Customers are solely responsible for ensuring they are authorised to upload, send, sign and share the documents they process through AKMSign, and that every recipient they add is a person entitled to receive that document.
AKMSign may add, change or discontinue individual features as the product develops. Material reductions in functionality will be communicated where appropriate.
2. Accounts and organisations
You must provide accurate account information and keep it up to date. You are responsible for protecting your credentials and for all activity performed under your account.
Each customer operates within a workspace. Workspace administrators are responsible for inviting users, assigning roles and permissions, removing users who should no longer have access, and for the actions their users take.
Using another person's or another company's account, credentials or signing link without authorisation is prohibited.
Notify AKMSign promptly if you believe an account, workspace or signing link has been compromised.
3. Electronic signatures
AKMSign provides electronic-signature technology together with evidence and audit functionality, including recipient verification steps, timestamps, activity records and a completion certificate with document integrity hashes.
AKMSign does not represent that every electronic signature created through the platform is legally valid or enforceable in every country, for every document type or in every context.
You are responsible for determining whether an electronic signature is appropriate for your particular document, transaction, counterparties and jurisdiction, and for obtaining your own legal advice where needed.
Certain categories of document may require additional formalities, notarisation, witnessing or a handwritten signature, or may be unsuitable for electronic signing under applicable law.
4. Documents and customer content
You retain ownership of, and responsibility for, the documents, data and content you upload to or generate through AKMSign.
You grant AKMSign the limited rights necessary to host, process, transmit, render, store and deliver that content for the sole purpose of providing the service to you, including delivering documents to the recipients you designate.
You must not upload or transmit content that is unlawful, fraudulent, infringing, malicious, or that you are not authorised to share.
5. Subscriptions and billing
AKMSign offers Starter and Business subscriptions, available on a monthly or annual billing cycle. The plans, prices, currency and taxes that apply to you are those presented at checkout at the time of purchase.
Payments are processed by Paddle, which acts as AKMSign's payment provider and, where applicable, merchant of record. Paddle's own terms and checkout disclosures apply to the payment transaction.
Paid subscriptions renew automatically at the end of each billing period unless auto-renewal is cancelled before the next billing date.
Plan limits — including the number of Admin and Sender seats and the included storage — are enforced by the platform. Signers and viewers do not consume a paid seat.
Failure to complete payment may result in the workspace losing paid write access until payment succeeds.
6. Cancellation
Cancelling a subscription in AKMSign means turning off future automatic renewal. It does not immediately terminate the billing period you have already paid for.
Your paid plan and its entitlements remain available until the end of the current paid billing period, after which the subscription ends.
You may resume automatic renewal from the Billing screen at any time before the scheduled cancellation takes effect, where the subscription state permits it.
7. No refunds
Subscription payments to AKMSign are non-refundable.
No prorated refund is given for unused subscription time.
Cancelling automatic renewal does not trigger a refund.
Downgrading a plan does not trigger a refund or a credit.
Nothing in this section limits rights that cannot lawfully be excluded. Refunds or reversals required by applicable law, by Paddle, by card networks, or through a valid chargeback or dispute process remain applicable and are handled accordingly.
8. Plan changes
Before any paid upgrade is processed, AKMSign shows a preview of the financial impact — the new recurring price, any proration and the amount due immediately — and the change is only executed after you explicitly confirm it.
Downgrades take effect from the next applicable billing period. They do not create an immediate charge, refund or credit, and the current plan remains available until the end of the paid period.
9. Free trial
AKMSign currently provides a free trial of 3 days for a newly created workspace, with the seat and storage allowances shown in the product at the time of sign-up. Trial terms may change for future sign-ups.
When the trial expires, paid write actions such as sending documents for signature are restricted until a subscription is started.
10. Data after a subscription or trial ends
When a paid subscription ends, the workspace enters a read-only retention window of 90 days.
When an unpaid trial expires, the workspace enters a read-only retention window of 30 days.
During read-only retention, users may sign in and access or download the existing documents and records they are permitted to see, but cannot perform normal paid write actions such as sending new documents for signature.
Starting or resuming a paid subscription during the retention window restores normal access without data loss.
After the applicable retention window ends, the workspace becomes eligible for deletion in accordance with AKMSign's data-retention policy.
Some information may be retained for longer where required for legal, financial, tax, security, fraud-prevention, dispute-resolution or regulatory purposes.
11. Acceptable use
You must not use AKMSign to:
· use the service for any unlawful purpose;
· commit fraud, forge a signature or impersonate another person or organisation;
· upload or distribute malware or other harmful code;
· gain or attempt to gain unauthorised access to any account, workspace, document or system;
· circumvent or attempt to circumvent security controls, plan limits, seat limits or usage limits;
· infringe the intellectual property, privacy or other rights of third parties;
· abuse signing invitations, reminders or platform communications, including sending unsolicited messages.
12. Availability
AKMSign does not promise uninterrupted or error-free availability, and does not offer an uptime guarantee under these Terms.
Access may be interrupted for planned maintenance, urgent security intervention, provider incidents or other reasonable operational reasons. We aim to limit the impact of such interruptions.
13. Suspension
AKMSign may suspend or restrict access to an account or workspace where reasonably necessary to address a security threat, suspected fraud or abuse, non-payment, or a serious breach of these Terms, subject to applicable law.
14. Warranties and limitation of liability
The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, AKMSign disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
To the maximum extent permitted by applicable law, AKMSign is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, data or business opportunity, arising from or related to use of the service.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct or death or personal injury caused by negligence.
15. Changes to these Terms
These Terms may be updated as the product and applicable requirements evolve. The date of the latest version is shown at the top of this page, and material changes will be communicated where appropriate. Continued use of AKMSign after an update constitutes acceptance of the updated Terms.
